Maryland has two statutes that relate to parent-child immunity and motor vehicle tort cases. They are section 3-904 and section 5-806. 3-904 provides that a wife, husband, parent and child of the deceased person may not be a beneficiary of wrongful death action for the death of a job of a parent under certain circumstances.
5-806 provides for a motor vehicle tort action by an unemancipated child against a parent of the child and an action by a parent against an unemancipated child of the parent up to the mandatory minimum liability coverage required in Maryland. This section also provided that the act shall apply to any case for wrongful death, personal injury or property damage arising from out of the operation of a motor vehicle tort case filed on or after the effective date of this Act which is October 1, 2002.
