All employers in the state are required by law to carry workers' compensation insurance. However, even if your employer does not have insurance, your case is still viable and you will be covered by a state fund for all benefits.

  • An injured worker has the right to confidentiality
  • An injured worker has the responsibility to inform his or her employer about a work-related injury or illness
  • An injured worker has the responsibility to fill out a claim form and submit it to the Commission
  • An injured worker has the responsibility to tell his or her doctor how the injury occurred and if it was work related

Basic Benefits
Most importantly, you are entitled to all necessary medical treatment for the rest of your life (by a doctor of your choice) including therapy, prescriptions and medical supplies that you may require to treat your injury. For the time that your doctor excuses you from work due to your medical condition, your employer's insurance company must pay you at least two-thirds of your regular wages (since this payment is tax-free, this should replace your income nearly in its entirety).

If you are left with any permanent disability or permanent residual symptoms you are also entitled to be compensated for the disability.

For severe injuries where you are unable to return to your former job or profession, the employer's insurance company is required to provide job search and/or job training which may last up to two years (during which time you are paid the same two-thirds of your regular wages).

Legal Fees
All attorneys’ fees for workers' compensation cases are controlled by statute. In addition, all fees in every case must be approved by the Workers' Compensation Commission before a lawyer can collect any fees from a client. NO attorney can charge a client fees for a workers' compensation case outside the statutory rates and NO attorney can charge any retainer fees up front.
